1. Acceptance of Terms

By accessing, browsing, or using Mappy Tools ("Mappy," "the Service," "we," "us," or "our") in any way, you agree to be legally bound by these Terms of Service ("Terms") in their entirety. If you do not agree to these Terms, you must immediately stop using the Service. These Terms constitute a binding legal agreement between you and Mappy Tools.

2. Description of Service

Mappy is an independent web-based mapping platform developed and operated by Nabil Bleik ("the Developer"). It provides four core tools — Map Maker & Freeform, Measurement Tool, Overlay Comparison, and Route Planner — along with a World Map explorer and a Projects feature for organizing and sharing saved work. The Service is provided as-is and features may be added, modified, or removed at any time without prior notice.

3. Eligibility & Account Registration

You must be at least 13 years of age to create an account or use the Service. By registering, you confirm that all information you provide is accurate and complete. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Mappy is not liable for any loss or damage arising from your failure to protect your account credentials.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:

• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
• Violate any applicable local, national, or international law or regulation
• Attempt to gain unauthorized access to any part of the Service, another user's account, or any systems or networks connected to the Service
• Reverse engineer, decompile, disassemble, copy, reproduce, or create derivative works of the Service or any part of it
• Scrape, crawl, or use automated means to access or collect data from the Service
• Use the Service to develop a competing product or service
• Copy, reproduce, or repurpose our ideas, UI design, infrastructure, documentation, marketing materials, or social media content
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the Service for commercial resale, redistribution, or sublicensing without express written permission from the Developer
• Interfere with or disrupt the integrity or performance of the Service or its underlying systems

We reserve the right to suspend or permanently terminate your account at our sole discretion, without notice, if we determine you have violated these Terms or acted in a manner harmful to the Service, other users, or the Developer.

5. User Content & Intellectual Property

You retain full ownership of any maps, images, routes, measurements, overlays, and other content you create or upload ("User Content"). By uploading User Content, you grant Mappy a non-exclusive, worldwide, royalty-free, limited license solely to store, process, display, and transmit your content as necessary to operate and provide the Service to you.

This license does not grant Mappy any right to sell, license, or commercially exploit your User Content. You are solely responsible for ensuring you have all necessary rights to any content you upload. Mappy does not claim ownership of your content and will not use it for any purpose beyond operating the Service.

All code, design, branding, logos, tooling, documentation, and other materials created by Mappy or the Developer are the exclusive intellectual property of Mappy Tools and Nabil Bleik. Unauthorized use, copying, or reproduction of any part of the Service or its materials is strictly prohibited and may result in legal action.

6. AI-Generated Results & Accuracy Disclaimer

The AI-powered measurement and analysis features within Mappy produce estimates only. Results are generated algorithmically and may not reflect real-world accuracy. You must not rely on Mappy's AI output for safety-critical, medical, legal, engineering, or any other high-stakes decisions without independent professional verification. Mappy makes no warranty of any kind, express or implied, regarding the accuracy, reliability, or completeness of AI-generated results.

7. Subscriptions, Billing & Refunds

Mappy Free is available at no cost and includes a defined set of features and usage limits. Mappy Pro is available at $4.99 per month or $49.99 per year, billed in advance. All paid subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date. You may cancel at any time through your account settings.

All payments are processed through third-party payment providers. Mappy does not store your payment card details. Subscription fees are non-refundable except where required by applicable law, or at the Developer's sole discretion upon written request to supportmappy@gmail.com. We reserve the right to change pricing at any time with reasonable notice.

8. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided strictly "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, or uninterrupted availability. Mappy Tools and Nabil Bleik expressly disclaim all warranties. Mappy does not warrant that the Service will be error-free, free of viruses or other harmful components, secure, or continuously available. You use the Service entirely at your own risk, and you assume full responsibility for any damage to your device or loss of data that results from your use of the Service.

9. Limitation of Liability

To the absolute maximum extent permitted by applicable law, under no circumstances shall Mappy Tools, its Developer (Nabil Bleik), or any of its agents, representatives, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages of any kind, including but not limited to: loss of data, loss of profits, loss of revenue, loss of goodwill, loss of business opportunity, service interruptions, system failures, or any other intangible losses, arising out of or in connection with your access to or use of — or inability to access or use — the Service, regardless of the cause of action (whether in contract, tort, negligence, strict liability, or otherwise), and regardless of whether Mappy was advised of the possibility of such damages.

This limitation applies even if any remedy set forth herein is found to have failed its essential purpose. In no event shall Mappy's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the greater of: (a) the total amount you paid to Mappy in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) $10.00 USD. If you have not paid anything to Mappy, our liability to you is zero.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnification

You agree to defend, indemnify, and hold completely harmless Mappy Tools, its Developer (Nabil Bleik), and any affiliated parties, officers, agents, and successors from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and court costs) arising out of or in any way relating to: (a) your access to or use of the Service; (b) your User Content; (c) your violation of any provision of these Terms; (d) your violation of any applicable law or regulation; or (e) your violation of any third-party rights, including intellectual property rights or privacy rights. This indemnification obligation survives termination of these Terms and your use of the Service.

11. Third-Party Services

Mappy integrates with or uses third-party services for infrastructure, authentication, AI processing, payments, email, and mapping data. These third parties operate under their own terms and privacy policies. Mappy is not responsible for the practices, content, or availability of any third-party service.

12. Termination

We reserve the right to suspend, restrict, or permanently terminate your access to the Service at any time, with or without cause, and with or without prior notice, at our sole and absolute discretion. We shall not be liable to you or any third party for any termination of your account or access to the Service. Upon termination for any reason, your right to use the Service ceases immediately and you must stop using the Service. All provisions of these Terms that by their nature should survive termination shall survive, including without limitation: intellectual property rights, warranty disclaimers, limitation of liability, indemnification obligations, and governing law.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising out of or in connection with these Terms or the Service shall first be attempted to be resolved informally by contacting us at supportmappy@gmail.com. If informal resolution fails, disputes shall be resolved through binding arbitration or the courts of the Developer's jurisdiction, at the Developer's election.

14. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will make reasonable efforts to notify users of material changes. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mappy Tools regarding the Service and supersede all prior agreements, representations, and understandings.

Mappy Tools ("Mappy," "we," "us," or "our"), operated by Nabil Bleik, is committed to protecting your privacy. This Privacy Policy explains what information we collect, how we use it, how we protect it, and your rights regarding it. 2. Information We Collect

• Account information: Your email address, display name, username, and encrypted password when you register.
• User Content: Maps, images, measurements, comparisons, routes, notes, and any other content you create or upload.
• Usage data: Anonymised, aggregated data about how you interact with the Service (e.g. which tools are used), used solely to improve the platform. We do not track individual browsing behavior across the web.
• Communications: If you contact us by email or the contact form, we retain your message and email address to respond to your inquiry.
• Payment data: If you subscribe to Mappy Pro, payments are processed by a third-party provider. We do not store or have access to your full payment card details.

3. How We Use Your Information

• To create and maintain your account and authenticate your identity
• To save, sync, and display your work across your devices
• To power the Projects feature (your username is visible to users you invite or who invite you)
• To process subscription payments via third-party billing providers
• To send transactional emails (account confirmation, password reset, billing receipts)
• To respond to support requests and inquiries
• To improve and maintain the Service using anonymised usage data

We do not use your data for advertising. We do not sell, rent, lease, or share your personal information with third parties for their marketing purposes under any circumstances.

4. Data Storage & Security

All user data is stored securely using industry-standard practices including Row Level Security (RLS), which ensures that only you — and any collaborators you have explicitly invited — can access your content. Passwords are stored in encrypted form and are never accessible in plain text. We use reputable, trusted infrastructure providers and take reasonable technical and organizational measures to protect your data against unauthorized access, loss, or disclosure.

No method of transmission over the internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your data, we cannot guarantee absolute security.

5. Third-Party Services

Mappy uses a limited number of trusted third-party providers to operate the Service, including services for database hosting and authentication, AI processing, web hosting, transactional email, payment processing, and typography. World Map uses openly licensed geographic data (Natural Earth, OpenStreetMap, CartoDB). Each third-party provider operates under its own privacy policy and data processing terms.

We do not sell, trade, or otherwise transfer your personally identifiable information to third parties except as necessary to provide the Service or as required by law.

6. Cookies

Mappy uses minimal, strictly necessary cookies solely for authentication and session management. We do not use tracking cookies, advertising cookies, or third-party analytics cookies. You may disable cookies in your browser settings, but doing so may prevent you from logging in or using the Service.

7. Data Retention

We retain your personal data for as long as your account remains active. You may delete your account at any time from Settings → Account → Delete account. Upon deletion, your account and all associated User Content will be permanently and irreversibly removed from our systems. We may retain anonymised, aggregated data that cannot identify you for analytical purposes.

8. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

• Access: Request a copy of the personal data we hold about you
• Correction: Request correction of inaccurate or incomplete data
• Deletion: Request deletion of your personal data
• Portability: Request your data in a portable format
